1. Agreement to terms

These Terms of Use ("Terms") govern your access to and use of the website https://opengoon.com and any related services (together, the "Service") provided by OpenGoon ("we", "us", "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your place of residence if higher, to use the Service.

The Service may involve adult or sensitive content. You are responsible for ensuring that using the Service is legal in your jurisdiction.

By using OpenGoon, you confirm that you are an adult (18+ or the age of legal majority where you live) and that you will only upload or generate lawful, consensual content involving adults. You must not use the Service for any content involving minors, non-consensual activity or real individuals (including celebrities or public figures) without their clear, informed consent.

3. Accounts and security

To use some features, you must create an account and provide accurate information.

You are responsible for:

• Maintaining the confidentiality of your login details
• All activity that occurs under your account

You must notify us promptly if you believe your account has been compromised.

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms or are using the Service in a harmful or illegal way.

4. Content, prompts and uploads

4.1 Your responsibilities

You are solely responsible for the text, images, videos and other content ("User Content") you submit, upload or generate through the Service.

By using the Service, you agree that you will NOT use it to create, upload, generate or share any content that:

• Involves or depicts minors in any sexual or exploitative context
• Depicts any person other than yourself (including celebrities or public figures) without their clear, informed and verifiable consent, or involves non-consensual or exploitative sexual activity
• Is illegal in your jurisdiction
• Infringes any third party's rights (including copyright, trademarks, privacy or publicity rights)
• Contains extreme violence, threats, harassment or hate speech
• Promotes terrorism or serious criminal activity
• Contains spam or malicious code
• Is otherwise abusive, harmful or in violation of these Terms

You must ensure that you have all necessary rights and permissions to use any material you upload, including reference images and other input content.

5. Generated content

The Service uses AI models to generate images and videos based on your inputs. Due to the nature of generative AI, outputs may be unexpected, imperfect or similar to content generated for others.

Subject to these Terms and applicable law:

• You may use, copy and share content you generate through the Service for lawful purposes, including personal and, where allowed by the laws of your jurisdiction, commercial use.
• We do not promise that generated content will be free of third-party rights (for example, if you use prompts referencing brands or copyrighted works).

You are responsible for ensuring that your use of generated content complies with all applicable laws and with any third-party rights.

6. Prohibited uses

You agree not to:

• Interfere with or disrupt the Service or its security
• Access or use the Service by automated means (bots, scripts, etc.) in a way that overloads or abuses the system
• Attempt to bypass usage limits, access controls or technical restrictions
• Reverse engineer or attempt to extract our models or source code, except as permitted by law
• Use the Service to provide competing AI generation services without our written permission

We may monitor use of the Service as reasonably necessary to operate it, enforce these Terms and protect our users.

7. Payments and credits

Some features of the Service require payment (for example, credits or subscriptions).

• Prices, formats (such as credits or plans) and availability may change at any time.
• Unless otherwise stated, all purchases are final and non-refundable, except where required by law or where we choose to offer a refund at our discretion.
• You are responsible for any fees charged by your payment provider (for example, card or crypto processing fees, currency conversion, etc.).

If we suspect fraud, abuse or payment disputes, we may suspend or limit your account and access to the Service.

8. Intellectual property

We and our licensors own all rights, title and interest in and to the Service, including but not limited to software, models, design, trademarks, logos and overall look and feel, excluding your User Content and generated outputs.

These Terms do not grant you any ownership rights in the Service. You may not copy, modify, distribute, sell or lease any part of the Service, nor reverse engineer or attempt to extract any source code, except as permitted by law.

9. Disclaimer of warranties

The Service is provided on an "as is" and "as available" basis.

To the maximum extent permitted by law, we do not make any guarantees or warranties about the Service, including that it will be uninterrupted, error-free, secure, accurate, or suitable for any particular purpose.

You use the Service at your own risk. You are responsible for your prompts, uploads and the way you use any generated content.

10. Limitation of liability

To the maximum extent permitted by law:

• We will not be liable for any indirect, incidental, consequential, special or punitive damages, or for loss of profits, data, business or reputation, arising out of or in connection with your use of the Service.
• Our total aggregate liability for any claims relating to the Service or these Terms will not exceed the greater of (i) the amount you paid us for use of the Service in the 3 months before the claim arose, or (ii) USD 100.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

11. Indemnity

You agree to indemnify and hold us harmless from and against any claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Service
• Your User Content or generated content
• Your violation of these Terms or of any law or third-party right

12. Termination

You may stop using the Service at any time and may request deletion of your account.

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe:

• You have violated these Terms
• Your use creates risk or possible legal exposure for us or other users
• We decide to discontinue the Service

If your account is terminated, certain provisions of these Terms that by their nature should continue to apply (for example, sections about intellectual property, limitation of liability and indemnity) will survive.

13. Governing law and disputes

Any disputes arising out of or relating to these Terms or the Service will be subject to the non-exclusive jurisdiction of the courts of Hong Kong.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top.

If we make material changes, we will take reasonable steps to notify you (for example, by posting a notice on the Service). Your continued use of the Service after any changes become effective means you accept the updated Terms.
